Contents to be examined:

 

1. For import of commercial seeds:
a. Qualification for seed import
b. Whether the seeds to be imported are suitable for being planted in China and their quality is acceptable
2. For seed import for oversea seed production:

Whether there is a seed production contract with a foreign party
3. For import of seeds for experiment:

Quantity of seeds to be imported

 

Legal basis:

 

1. Seed Law of the People’s Republic of China  
2. Regulations on Administration of Agricultural Genetically Modified Organism (GMO) Safety  
3. Interim Measures for Administration of Import & Export of Crop Seeds/Seedlings (promulgated by Decree No. 14 of the Ministry of Agriculture (MOA) in 1997)

 

Requirements:

 

1. Examination findings of the agricultural authority of the province where the enterprise is registered
2. The enterprise applying for import of commercial seeds shall obtain the Seed Business License for seed import & export issued by MOA and the Seed Import & Export License issued by the foreign trade authority (For seed import for oversea seed production and import of seeds for experiment, the above requirement is not applicable)
3. The quality of the commercial seeds to be imported shall meet national or industrial standards or the standards stipulated in the contract if there are no national or industrial standards; and variety identification is required if the commercial seeds of main crops are to be imported.
4. The following documents are required:
a. Examination and Approval Form for Import/Export of Crop Seeds/Seedlings  
b. Crop Seed Business License (except import of crop seeds for non-business purposes, such as seed import for oversea seed production and import of seeds for experiment)
c. Business License for an Enterprise as a Legal Person
d. Import & Export License (The applicant without import & export right shall entrust an organization with import & export right and provide the Business License for an Enterprise as a Legal Person, corresponding Crop Seed Business License and Import & Export License of the agent.)
e. Variety identification certificate in the case that the seeds of main crops are to be imported
f. Approval Document on Safety of Agricultural GMOs or other approval documents on agricultural GMO import in the case of import of genetically modified seeds  

 

Procedures:

 

1. Acceptance of application documents. The General Office for Administrative Examination and Approval of MOA accepts and preliminarily examines the Examination and Approval Form for Import/Export of Crop Seeds/Seedlings and related documents submitted by the provincial agricultural authority.
2. Examination. The Department of Crop Production of MOA examines the application documents according to related national regulations.
3. Reply. The Department of Crop Production makes a proposal according to the examination findings, submits it to the minister for final examination and then gives a written reply to the applicant.
