Content to be examined:

 

Qualification and capacity of an agricultural product quality and safety testing body for providing data and results for certification

 

Legal basis:

 

1. Law of the People’s Republic of China on Quality and Safety of Agricultural Products
2. Measures for Appraisal of Agricultural Product Quality and Safety Testing Bodies (promulgated by Decree No. 7 of the Ministry of Agriculture(MOA) in 2007)

 

Requirements:

 

1. An agricultural product quality and safety testing body that is established or authorized by an agency under the State Council on a legal basis may apply to MOA for the appraisal with the approval of the said agency.
2. The following documents are required:
a. Application for Appraisal of Agricultural Product Quality and Safety Testing Body
b. Legal personality certificate or authorization certificate of the body (photocopy)
c. Document that certifies approval of a superior or related agency for establishment of the body (photocopy)
d. Quality system documents (including quality manual, documents on procedure and management system, and lists of operation guide books)
e. Metrology accreditation certificate and its attached form if the body holds metrology accreditation (photocopy)
f. Two reports on typical testing cases in the past two years
g. Qualification certificates of technicians (including academic certificate, appraisal certificate issued by an agricultural authority at or above the provincial level, and certificate of medium- or senior-level technical title) (photocopy)
h. Technical title certificates of the person responsible for technical matters and the person responsible for quality matters (photocopy)

 

Procedures:

 

1. Acceptance of application documents. The General Office for Administrative Examination and Approval of MOA accepts and preliminarily examines the application and related documents submitted by the agricultural product quality and safety testing body.
2. Technical examination. The Department of Market and Economic Information (DMEI) of MOA entrusts technical examination of these documents to a technical examination body.
3. On-site examination. DMEI designates an expert group to perform on-site examination.
4. Reply. DMEI makes a proposal according to opinions of the expert group, submits it to the minister for final examination and then gives a written reply to the applicant.

 

Promised time limit: 20 workdays (no more than two months for on-site examination)
