Legal basis:
1. Regulations of the People’s Republic of China on Protection of Wild Plants
Requirements:
1. Approval of the provincial agricultural authority
2. The following documents are required:
a. Application Form for License for Import/Export of National Key Protected Wild Plants
b. Legal personality certificate of the applicant (photocopy)
c. Import/export contract (agreement) (photocopy)
d. License for Collection of National Key Protected Wild Plants (photocopy) issued by the agricultural authority at or above the provincial level or its authorized institution in the case of export of wild plants and their products; and sale and purchase approval document issued by the provincial agricultural authority and the purchase and sale contract (all photocopies) in the case that wild plants are purchased for export
e. Description on product ingredients and specifications recognized by the agricultural authority at or above the provincial level at the location of the producer and the test report on product ingredients produced by a professional research and testing institution at or above the provincial level in the case of export of products containing ingredients of national key protected agricultural wild plants
f. Qualification certificate of the importer/exporter (photocopy) issued by the foreign trade agency of the State Council or its authorized institution in the case of import/export for trade
Procedures:
1. Acceptance of application documents. The General Office for Administrative Examination and Approval of MOA accepts and preliminarily examines the Application Form for License for Import & Export of National Key Protected Wild Plants and related documents submitted by the provincial agricultural authority.
2. Examination. The Office for Wild Plant Protection of MOA examines the application documents, solicits opinions of related MOA departments and forwards the documents to the MOA Expert Examination Committee on Wild Plant Protection for examination when necessary.
3. Reply. The Office for Wild Plant Protection makes a proposal according to the examination findings, submits it to the minister for final examination and then gives a written reply to the applicant.
Promised time limit: 20 workdays (no more than 40 workdays when expert examination is required)
